This concept provides that in every aspect of thinking it should be accompanied by action
and application. It can be defined as the action reflection of persons upon the world. This
learning style entails that a student is expected to be active and interact with others in the
relevant environment. It promotes self-awareness and expression with relevance and
meaning. These aspects contribute a great deal to the learners’ knowledge of the real
world in which he/she lives.
1.2. Legal Practice Act 28 of 2014
a. Preamble
In general, a preamble is an introductory statement in a document that explains
the document’s purpose and its underlying philosophy.
The Legal Practice Act regulates the conduct of lawyer/ legal practitioners in South
Africa. It provides a legislative framework for the transformation and restructuring
of the legal profession into a profession which is broadly representative of the
Republic’s demographics under a single regulatory body.
b. Long Title
The long title of the Act explains the purpose of the Act. The Legal Practice Act
provides a legislative framework for the transformation and restructuring of the
legal profession in line with constitutional imperatives to facilitate and enhance an
independent legal profession that broadly reflects the diversity and demographics
of the Republic. It further provides for the establishment, powers and functions of
a single South African Legal Practice Council and Provincial Councils in order to
regulate the affairs of legal practitioners and to set norms and standards; to provide
for the admission and enrolment of legal practitioners.
