The Alternative Dispute Resolutions that would be appropriate in this circumstance is arbitration
because there would be a third part an arbitrator who assist the parties to settle down a dispute.
1.2 Yes, in this matter going to court is an option because there is a claim of damages and the court will
be a Civil Court. To be more specific the Magistrate court.

2.1 The method which was used to resolve this dispute is negotiation.
2.2 Yes, the dispute can be resolved by courts and the court will be a Small claims court because there
is compensation and claim of damages.

They parties have tried negotiation method and it was unsuccessfully because they were unable to
come to an agreement.
3.2 They can use arbitration or mediation methods, where there would be a third party to assist them
to negotiate a settlement or to help them with their decisions.

4.1 This case can be heard in a magistrate court because the dispute is between individuals and the
other party is claiming for compensation. Hence the magistrate court has inherent jurisdiction.
4.2 In this case for one to get the money back he or she should follow the decision of the court to wait
until Mr Baloyi decides to start building or, to cancel the contract between them and given the deposit
money back.
