An initial advantage of access to justice in civil cases is that it can be accessed privately
through conditional fee agreements. This is an advantage as is means that it can often be
cheap to launch a claim privately. This is also an advantage because it means that if the
person does not win their case then they do not have to pay the majority of the costs of
court. On the other hand, some people believe this is problematic as if you win the case a
success fee will be added on as well as what you would have to pay originally.
A further advantage of access to justice in civil cases is that it is tough to qualify for. This is
an advantage as it means that people are more likely to settle outside of court. This is also
an advantage as it means that less time will be spent on the claim and the resources of the
court will not have to be used in order to reach an outcome for the case. However, some
people believe that this reduces the consistency of decisions as they are not always made
by a legally qualified person.
Another advantage of access to justice in civil cases is that it is only given to those who
really need it. This is an advantage as it means that money is not given to those who could
easily support themselves throughout a claim. This is also an advantage as it means that the
government gives out less money meaning that it still has money to invest in different areas
that may be important. On the other hand, some people think that the requirements are too
hard to satisfy in order to be able to qualify for legal aid.
Finally, another advantage of access to justice in civil cases is that it increases the number
of legal firms who will give legal aid for less money. This is an advantage as it makes
seeking legal aid fairer as people are more likely to be able to receive it. However, many
people believe that due to the lack of funding by the government some organisations are
hesitant when it comes to offering legal aid in civil cases.
