Afnan Abbasi, a 24-year-old Pakistani student decided to conduct his master’s degree abroad
in the United Kingdom. At the moment of departure there was no fear of persecution. While
studying abroad in the UK, Afnan got in contact with some local refugees and soon started to
befriend them. After 10 months, he completed his studies, and his visa was expiring. Afnan
started to think of ways to stay in the UK. He ran out of money, so extending his visa was not
an option. One of his refugee friends told him, that he got refugee status based on fear of
persecution from the authorities of his country of origin. He suggested Afnan to create a
scene and create a pretext for invoking fear of persecution.
Afnan purposely took part in activities online and onsite expressing his extreme opinions
against the Pakistani authorities. He also organized a demonstration via Facebook. The
Pakistani authorities got a hear of this and started to threaten Afnan if he did not stop his
activities immediately. Afnan continued his activities and applied for asylum in the UK. In his
application Afnan mentioned that returning to Pakistan would be too dangerous for him
because of fear of persecution from the Pakistani authorities.
Does Afnan fall under the protection of the Refugee Convention? In your answer, include
the concepts of refugee sur place and good/bad faith and apply this to the case at hand.
