Employers and employees responsibilities
Employers and employees have basic legal responsibilities when it comes to safety.
Legislation is a common practice for governments around the world to regulate safety.
In South Africa, workplace safety is governed by the Mine Health and Safety Act 29 of
1996 as well as the Occupational Health and Safety Act 85 of 1993. Employers and
employees are subject to different legal responsibilities under the Acts.
Employers' basic safety responsibilities
Employers are legally responsible for ensuring that, wherever and whenever their
employees perform tasks, the safety risks they are exposed to aren't greater than
their competence to handle. An employer is someone who has subordinates reporting
