We hereby agree to list and offer for sale our property hereinafter described and
give you the sole and exclusive right to and including December 28, 2008 to sell
11421 Berry Street Legal: Lot 32, Block 5
Bayview Meadows together with attached fixtures for the sum of
$65,900.00 upon the following terms: Cash, Convention Loan
I agree to pay you a cash commission of 7% of the gross sale price.
A. If a sale is made, to a purchaser found, who is ready, willing and able to
purchase the property before the expiration of the listing, by you, myself, or any other person, at
the above price and terms or for any other price or terms I may agree to accept.
B. If you are unfairly hindered by me in the showing or attempting to sell said
premises within the listed period.
C. If I make a sale of said premises to anyone due to your efforts or advertising
done under this listing within 90 days after the expiration date. This
property is offered without respect to race, color, national origin or religion.
In case of the forfeiture, by a perspective purchaser, of any earnest money payment, upon the within described
property, said earnest money, after expense incurred by you has been deducted, shall be divided one-half to the
owners and one-half to the agent.
I hereby represent that to the best of my knowledge, information and belief the following describes the true
condition of the hereinbefore described real estate and premises, to wit; a) there are no termites in the building;
and b) the lower level or basement level under such residence is free from leakage or seepage of water.
However, if termites or leakage or seepage are found in said building and it is known or discovered that any
such condition existed prior to closing, I shall indemnify you for any loss or expense incurred by you as a
result.
I agree to furnish either a complete abstract certified to date of sale showing merchantable title or a Title
Insurance Policy, to complete said sale and to pay any expense incurred in perfecting the title in case it is
found defective, and convey within 30 days from date of sale, the property by warranty deed, or none other
