Implied Consent: When a person is unconscious or otherwise incapable of making a rational, informed decision about care, and unable to give consent to care the law assumes that the patient would give consent to care and transport to a medical facility if he or she were able to do so. c. Involuntary consent: Assisting patients who are mentally ill, developmentally delayed, or who are in behavioral (psychologic) crisis is complicated. i. Ex: An adult patient who is mentally incompetent is not able to give informed consent. Consent from a parent or guardian must be given in the case of a minor if they are not available you treat the minor. Prisoners fall under this consent as well. d. Minors and Consent: When a parent is cannot be reached to provide consent, health care providers are allowed to give emergency care to the child. Some minors can give consent based on the minors age, and maturity. Emancipated minors can be legally treated as adults based on certain circumstances. 12. Assault: a. Unlawfully placing a patient in fear of bodily harm 13. Battery: a. Unlawfully touching a patient or providing emergency case without consent. 14. DNR a. Do Not resuscitate b. Living will c.
