a) The disciplinary procedure is necessary to inform/ remind the employee Mr Kot of what is
expected of him and ensure compliance with the company standards in operating
procedures, this will also serve as proof of warning in case Mr Kot offends again in that
regard
b) The following procedure is recommended for Mr Kot assuming the conversation between
him and his superior Mr Let.
1. Informal conversation- the manager has already carried out this step by approaching Mr
Kot and presented the inadequacies of the work of Mr Kot
2. Oral warning- Mr Kot should be called to a formal meeting in the presence of the
Human resources manager and Mr let to be given a formal warning of the disciplinary
measures to be taken in case he breaches his contract again in that regard
3. A written warning must then be issued twice to set as proof the employee has been
warned twice. The warning must be signed by the employee in the presence of the
human resources manager, the superior and the lawyer of the employee should he/she
chooses to have them present
4. Should the problem persist then a suspension without pay may be instigated against Mr
kot
5. Mr Kot can be demoted if the problem persists and replaced with some junior staff
acting in his position.
6. Finally if there is no change in the employee’s behaviour then he has to be dismissed so
as to preserve the business
c) Mr Kot may approach tribunal that can hear his case , Arbitration and conciliation as well can
be methods used to repeal against the decision of management
