1. The examination question paper counts 100 marks.
2. It consists of fourteen (14) questions. Answer ALL the questions and fully substantiate with reference
to your Study Guide, case law and legislation where applicable. Strictly adhere to the indication
regarding the number of lines that each answer should consist of. You will be penalised if you
do not adhere to this. Please do not include the questions in your submitted answers. Number
answers correctly and chronologically.
3. The duration of the examination is from 12:00 – 16:00 (4 hours). In addition to the duration of the
examination, you are given 30 minutes to FINALISE the uploading of your exam file. Your exam
file must therefore be uploaded via the myExams platform on 8 February 2025 BEFORE 16:30
(South African Standard Time).
4. Although this is an open-book examination, while the examination is in progress, you are not allowed
to consult another person. You may consult the prescribed material for this module. This includes the
Study Guide and the prescribed cases mentioned in the 101/3/2023 tutorial letter which are available
in the e-reserves of the library.
5 While the examination is in progress, you are not allowed to assist another student in answering any of the
questions for this examination.
6. You must tick the Honesty Declaration. However, do not include any other Honesty Declaration in your
submitted answers.

a prescribed court decision to answer a specific question, your answer must contain the
reference to the name of the court decision as well as a reference to the specific paragraph that
you consulted. Do not insert footnotes. Instead include all references in brackets following each
answer. We will not allocate marks for direct quotations from the Study Guide. You will be
assessed on your own level of understanding and interpretation of the relevant legal principles
by looking at how well you applied the most relevant material to answer the questions.

Read the following set of facts before you answer the questions:
In 2022, Mr. and Mrs. Khumalo sold their farm to Peter and Jenny who are married in
community of property. A right of usufructuary was reserved over the farmstead in favour of
the Khumalos for as long as they lived. This right has not yet been registered against the title
deed of the farm. Peter and Jenny sold the farm to Matilda, who knew about the usufructuary
agreement between Peter, Jenny and the Khumalos.
Matilda decides to develop a part of the farm as a sectional title unit complex. However,
legislation stipulates that the area must only be utilised for agricultural purposes. Matilda,
nevertheless, developed a sectional title unit complex on a portion of the farm because, in her
opinion, the farm belongs to her, and therefore, she is allowed to make her own decisions
regarding the farm.
Matilda makes life unbearable for the Khumalos due to constant excavations near their
farmstead. As a result of the nuisance and Matilda’s ill-mannered behaviour towards them, the
Khumalos had to leave the farmstead on the farm on which they lived. The Khumalos describe
themselves as pensioners struggling to make ends meet on their small state pension. They are
