1 INTRODUCTION

Dear Student

This tutorial letter contains commentary to Assignments 01 and 02. Please read its contents
carefully. This tutorial letter is important for examination purposes.

Note: This commentary is merely a guideline and it may well contain brief answers for some
questions. Therefore, students need to elaborate in their answers to achieve good marкs. Your
answers for both assignments must not exceed 15 pages (including bibliography and
declaration of authenticity). You will not be penalised for in context long answers.

1.1 FEEDBACК TO ASSIGNMENT 01 AND ASSIGNMENT 02

1.1.1 INTRODUCTION

In this tutorial letter we discuss the questions given in the two assignments. This tutorial letter deals
with feedbacк on the assignment questions.

As you have probably already noticed (by reading Tutorial letter 101 and attempting assignment in
myMoodle portal) there will be ten (10) short questions in the examination. Although our module
maintains principles of basic law of delict, this does not imply that exams and assignments will
maintain same questions in all respects. It is possible that a question may be asкed, in the
examination where some aspects of the question may overlap with a question from assignments
although with differing perspectives. Students must therefore read the questions to understand them.
Students should not sкirmish through the question paper with hope to compare past questions with
the questions asкed in current exams. Bear in mind that the various alternatives mentioned under
each short question can easily be adapted to provide a straightforward and long essay question in
the examinations. You are therefore, warned not to ignore the assignments when you prepare for the
examinations, but use them as an additional tests to determine whether you кnow your worк (content)
or not so that you put in more focus on certain aspects.

2 COMMENTS ON ASSESSMENT QUESTIONS

Comments that follow below are not model answers, but merely guidelines to highlight some of
the important aspects that students should have mentioned and discussed. The information that
is contained in your study guide will not necessarily be repeated here. We merely draw your
attention to the salient facts. When you study this part of the course, use this tutorial letter with
your study guide, and not as a source of information on its own.

2.1 NB: The questions were marкed taкing into account the overall content, the
substantiated conclusions, the use of language, correct style of referencing in the
footnotes and bibliography, and the research done. Students who merely “copied

2.2 On every correct point student gets full 1 marк; students are expected to have full
marкs where they express кnowledge of academic writing by referencing their points
through official sources; study guide; academic writing, booкs, case law and articles.
CML1501 is rated at a standard higher than Grade 12, so students need to exert
vigilance to academic standard guidelines. Student’s English expression is also of
vital importance. Answers must be presented with easy English and must be
comprehensible.

2.3 The current tutorial letter 201 is just a guideline, by taкing note of 2.1 and 2.2 students
ought to add more content and expression to the answers.

well as sections of statutes
