1. Would you want a community treatment program in your neighborhood? Why or why not?

Solution
This is a tough question to answer. While I am an advocate of community treatment programs, I
would prefer that these programs be offered in areas of the city (such as downtown) where public
transportation would be readily available if needed.


2. Is widening the net a real danger, or are treatment-oriented programs simply a method of helping
troubled youths?

Solution
I do not believe widening the net is a real danger. Treatment-oriented programs are typically a
method of helping troubled youth, and as a rule, they often work. Yes, this method may lead to
having more juveniles under some type of ‘formal’ supervision, but treating the juveniles before
their delinquency escalates and becomes more serious is important.


3. If youths violate the rules of probation, should they be placed in a secure institution?

Solution
This is a question that does not have a cut and dry answer. Juveniles often make mistakes and
have issues with authority figures. If a juvenile violates probation for a non-serious or technical
violation, then they likely should be given a second chance. But, if the juvenile has violated
probation by committing a new serious and violent offense, has violated probation multiple times,
or is a serious and violent juvenile offender who is on probation, then perhaps a juvenile in this
situation should be placed in secure detention should they violate probation.


4. Is juvenile restitution fair? Should a poor child have to pay back a wealthy victim?

Solution
Restitution, in principle, is fair even if it is applied to juveniles. Requiring the juveniles to pay

what it means to take responsibility for their actions and understand that actions have
consequences. However, restitution should be set at a feasible amount for the juvenile to pay.


5. What are the most important advantages to community treatment for juvenile offenders?

Solution
The most important advantages of community treatment for juveniles is that they are not
incarcerated, get to stay close to their friends and family, perhaps work/go to school, and not
suffer the pains and adverse consequences of being incarcerated.


6. What is the purpose of juvenile probation? Identify some conditions of probation and discuss the
responsibilities of the juvenile probation officer.

Solution

The purpose of juvenile probation is to teach offenders and help them better understand their
actions and consequences. This learning process takes place in the community, allowing them the
opportunity to practice prosocial engagement with some supervision. Some of the conditions of
probation, such going to school, attempting to gain employment, and attending counseling are
monitored by the juvenile probation officer who is part officer, part counselor, and often part
social worker.


7. Has community treatment generally proven successful?

Solution
Community treatment has generally been proven to be successful. The collaboration of
community members and community agencies allows offenders to be rehabilitated in their own
setting and improve their lives. The community has a stake in the rehabilitation of the offenders
who live in that community (reduced crime, increased safety, etc.).


8. Why have juvenile boot camps not been effective in reducing recidivism?

Solution
A variety of reasons exist as to why juvenile boot camps have not been effective in reducing
recidivism. Some of these reasons include: the camps not focusing enough on rehabilitation, the
camps being seen more as punishment, and the fact that the youth who attend these camps often
return to already destructive and chaotic neighborhoods after finishing the juvenile boot camp. In
essence, life in their neighborhood/family is far from the strict and often militaristic nature of
how they were treated in the boot camps.

1. Discuss and identify the major participants in the juvenile adjudication process. What are each
person’s roles and responsibilities during a juvenile trial?
Solution
The major participants in the juvenile adjudication process are the judges, lawyers, the guardians
ad litem, social service caseworkers (if necessary), and of course, the juvenile. The roles are
multifaceted, but generally speaking, the judge makes the decision on what happens to the
juvenile, the lawyers argue for (defense attorney), or against the juvenile (prosecutor), and the
guardian ad litem represents the interest of the minor in question. Social services provides details,
if necessary, relating to the family situation, and the juvenile is the one dealing with potential
outcomes. Parents may also have a role in these types of situations, primarily through their
involvement with social services.

2. The criminal justice system in the United States is based on the adversarial process. Does the
same adversary principle apply in the juvenile justice system?
Solution
Allegedly, it does not, but at times, it is apparent in the juvenile process. Remember, the juvenile
prosecutor was not an original member of the juvenile court system because of the adversarial
nature of having a prosecutor and defense/defendant. The goal of the juvenile court was to be
more treatment-oriented, specifically attending to the needs of the juvenile, not prosecuting them.
The insertion of the juvenile court prosecutor may make the system more adversarial than its
original intent. If you have ever spent some time in a juvenile court, it is easy to notice that there
is often some hostility in the air, and the juvenile’s best interests are not being accounted for at all
times. It is often a thin line between the need/want/purpose of ensuring the best interests of the
child against the state’s interest of protecting the community.

3. Children have certain constitutional rights at adjudication, such as the right to an attorney and the
right to confront and cross-examine witnesses. But they do not have the right to a trial by jury.
Should juvenile offenders have a constitutional right to a jury trial? Should each state make that
determination? Discuss the legal decision that addresses this issue.

In principle, juvenile offenders should not have a constitutional right to a jury trial, nor should
