1. Definition of Private Defense
Private defense refers to a legal ground of justification where a
person, including a security official, may lawfully use force to
protect themselves, another person, or property against an
unlawful attack. It is a recognized defense in criminal law that
excuses conduct which would otherwise be unlawful.
2. Circumstances for Invoking Private Defense
o Unlawful Attack: The act must be in response to an
unlawful and wrongful attack by another person. The
threat must not be authorized by law.
o Protected Interests: The defense may be used to protect
life, bodily integrity, dignity, or property of the security
official or another person under their protection.
o Imminence of Attack: The attack must be imminent or
already underway. It cannot be based on a future or
speculative threat.
o Necessity: The defensive action must be necessary to
repel or prevent the attack. If there are other safe and
reasonable alternatives, the official cannot rely on private
defense.
