 Question 1

1. Draft the vesting clauses for the transferees listed below, as required by the Deeds Registries
Act 47 of 1937 and the regulations issued thereunder. You may use your imagination for any
missing details:

A) A partnership where at least one of the partners is married in community of property.

"By virtue of the provisions of the Deeds Registries Act 47 of 1937, it is hereby declared that the
property described herein shall vest in the partners of the partnership known as [Partnership Name],
being [Partner 1's Full Names] (Identity Number: [ID Number]), married in community of property
to [Partner 2's Full Names] (Identity Number: [ID Number]), and [Partner 2's Full Names], the
surviving partners of the partnership, jointly and severally, in accordance with their respective shares
and interests as stipulated in the partnership agreement dated [date]."

B) A person who does not have a valid identity document.

"By virtue of the provisions of the Deeds Registries Act 47 of 1937, it is hereby declared that the
property described herein shall vest in [Full Names of Transferee] (identity number not available)
whose identity and capacity have been verified in accordance with the applicable requirements of the
Deeds Registries Act 47 of 1937 and relevant regulations."

C) A trust.

"By virtue of the provisions of the Deeds Registries Act 47 of 1937, it is hereby declared that the
property described herein shall vest in the trustees of [Trust Name] (Registration Number: [Trust
Number]), namely [Trustee 1's Full Names] (Identity Number: [ID Number]), [Trustee 2's Full
Names] (Identity Number: [ID Number]), acting jointly and severally, as trustees of the trust in
accordance with the terms and provisions set out in the trust deed dated [date]."

These clauses adhere to the requirements of the Deeds Registries Act 47 of 1937, including details of
the partners, individuals, or trust involved, along with the applicable identity information where
necessary.
