the atrocities of World War II catalyzed a transformation in global
governance that placed the individual at the center of international law.
As a result, IHRL developed into a robust body of law dedicated to
safeguarding the fundamental rights and freedoms of all human beings,
regardless of nationality, race, religion, or status. This legal discipline
coexists with other domains of international law—most notably
international humanitarian law (IHL), international criminal law (ICL),
and international refugee law (IRL)—which, although complementary,
serve distinct objectives, operate within different frameworks, and target
different circumstances.
This essay critically explores the nature, development, and principles of
IHRL. It then systematically distinguishes IHRL from IHL, ICL, and
IRL, highlighting key differences in their scope, enforcement
mechanisms, actors, and areas of application. Ultimately, the essay
argues that understanding these distinctions is essential for effective
human rights advocacy, policy formulation, and legal enforcement in
both national and international contexts.
