Each of the following sub-questions contains one statement but with multiple possible
answers. Only one of the answers is correct. Read each statement very carefully and
then decide which one of the options is the correct one. In your examination script
(answer book), write down only the sub-question number and, next to it, the letter that

1.1 Clive and Philip enter into a contract in terms of which Philip has to deliver five
(5) indigenous bulbs to Clive. Clive has already paid the purchase price as it is
very difficult to find these indigenous bulbs. However, Philip now indicates that
he does not intend to perform in terms of the contract and that he would rather
give the bulbs to his new girlfriend.

1.2 Donny sells his car to Stuart and his library of rare books to Chris. It is an
express term of the contract between Donny and Stuart that the car must be
delivered by 6 June 2023. The contract between Donny and Chris does not
stipulate a date for the delivery of the books to Chris. Donny fails to deliver the
car to Stuart and the books to Chris.
Indicate which ONE of the following statements in respect of the legal steps that
may be taken against Donny is CORRECT:
A. Stuart and Chris may, in principle, claim delivery of the car and the books,
respectively.
B. Stuart cannot claim delivery of the car but can only cancel the contract.
