Army Directive 2012 - 18 Correct Answ_Military Occupational Specialty Administrative

Retention

Review (MAR2).

-Signed 23 August 2012.

-Modifies but does not rescind AR 600-60.

Two ways Active Army enlisted to be "retained" to complete MEB/PEB Correct Answ_-

Extension of enlistment contract under AR 601-280, para 4-9, during re-enlistment window.

-Retained past ETS under AR 635-200, para 1-24 a(2)

"Duty-related (DR)" process Correct Answ_-Implements 10 USC chapter 61, Retirement or

Separation for Physical Disability.

-DES evaluation consists of MEB plus PEB.

-PEB determines -

*Fit/unfit for purposes of retention/separation.

*Whether the unfitting disabilities are "compensable" (service-connected).

, *Disability disposition (retirement or separation for disability).

-Includes non service-connected (EPTS) cases of Regulars and Reservists when Soldier is on a

call to active duty of more than 30 days.

*Exception: Mobilized RC released by 30th day.

-Formerly included cases of disability incurred due to Soldier's misconduct etc., when command

did not pursue administrative separation for misconduct or punitive UCMJ action.

*Effective 5 August 2014: DoDI 1332.18, Appendix 1 to Enclosure 3, para 4a(5), appears to

exclude referral of Soldiers whose disability results from intentional misconduct or willful

neglect or was incurred during a period of unauthorized absence or excess leave.

Non duty-related process Correct Answ_-Promulgated by DoD policy.

-Pertains to RC not on AD and pending disqualification for non service-connected medical

impairments.

-Pertains to RC released within 30 days of mobilization for a pre-existing condition that is non

service-connected.

-MEB not conducted but the medical basis for diagnosis and disqualification must be presented.

*See USAPDA memorandum, 20 June 2013, subject: Non-Duty Related (NDR) case

Submission to Physical Evaluation Board (PEB): Clarification of Procedures and Required

Information.

-PEB considers only the issue of fit/unfit.
