Mziki High School is a small, culturally diverse high school with only 90 learners. The
school is situated in an urban working class neighbourhood. The school’s official
colours are blue and white. The teachers at Mziki High School are:

Mr K. Zondi (School Principle for the past ten years)

Mr A. Scott (A Young grade 12 teacher who is very popular among the learners)

Me B. Adams (A Grade 11 teacher with 21 years of teaching experience)

Mr E. Patel (A Grade 10 teacher who is sickly and has plans to retire at the end of
the year)

Mr R. Ceyster (A very short tempered Grade 9 teacher)

Miss H. Combi (A young and friendly Grade 9 teacher)

Mziki High School is enclosed by only a 1 meter high fence. Recently criminal
elements were observed moving in and out of the school.

1. What fundamental human rights of learners are threatened here? Name the
specific right as well as the article number (2)

Mnr Zondi has a staff meeting where he reminds teachers of their duties of pastoral
care. He draws up a time table for playground duty and orders teachers to take turns
in patrolling the school premises during intervals. He also equips them with a pair of
binoculars and a whistle which might aid them in performing playground duty.

2. Name two common law principles that compel teachers to do playground duty
