The nature of the agreement between Effective Solar (ES) and the Solar Workers Union
(SWU) mentions that all employees of ES must become members of SWU. This type of
agreement is a closed shop agreement. In this agreement the employees are required
to join the majority union. An employer can dismiss an employee if he/she does not
want to join the trade union, is refused membership to the union or has been barred
from the union.
The agreement does infringe on the right to freedom of association. This is a primary
human right that allows people to join associations such as trade unions of their choice.
It also includes the right not to join or be forced to join any association/trade union.
With regards to the agreement between ES and SWU, it can be seen that the
agreement infringes on the right to freedom of association of ES's employees.
By essentially forcing all employees to become members of SWU, the agreement
restricts their freedom to decide whether or not to join a trade union or who to associate
with. It takes away the employees right to choose a different trade union or to not join
any trade union if they wish not too.
