ABSTRACT
One of the many constitutional frameworks adopted by South Africa after the
historic 1994 election was the Constitutional Court (CC). This hypothesis therefore
aims to highlight not only the role the Constitutional Court plays in shaping our legal
precedent but also its role toward the advancement of direct access to the court by
individuals. This direct access is important not just for the protection or conferment
of our fundamental rights but also for matters on general public importance.
Although, sections 167 of the Constitution confers significant powers to the
Constitutional Court (CC), there remains much development needed in order for
the court to be able to achieve greater access to justice in matters of general public
