Based on the example, she lacks minimum contacts and has no reason to be sued in North Dakota. Personal Jurisdiction rules are defendant oriented. The plaintiff's contacts with the forum do not suffice. If Austin would have sued in Minnesota, it may have been different. As a result of the same accident, Healy brings suit against Austin for her injuries in South Dakota. Does the court have jurisdiction over Austin based on minimum contacts? - Answer- No, Austin only has SOME limited contacts in the state so they would not have personal jurisdiction over him. Int'l Shoe does not hold that the defendant have SOME contacts, but by committing LIMITED ACTS in the state. Healy's claimis unrelated to Austin's brush sales in South Dakota. Austin had no reason to believe that he was submitting himself to jurisdiction in SD for an accident in MN. The claim would be different if it were for faulty brushes sold in SD. The only way that Healy could sue Austin in SD would be if she serves him as a "transient visitor." To be on the safe side, Healy also files suit against Austin in Minnesota. Does that court have personal jurisdiction over Austin based on minimum contacts? - Answer- Healy has gotten it right by suing Austin in Minnesota. Austin has minimum contacts in Minnesota. It would be unfair to allow drivers to drive on out of state roads but not hold them accountable for accidents they are involved in on their highways. Even if the accident was the only thing that Austin did in MN, it would be sufficient for contacts. Hudson, an Ohio citizen, buys a Volkswagen from Smoky Mountain VW, located on the east side of the Smoky Mountains in NC, while she is on vacation there. Shortly after she returns home, all four wheels fall off while she is driving, and Hudson is injured. Understandably upset, Hudson sues Smoky Mountain in an Ohio court for negligence. Does the Court have personal jurisdiction over the deal? - Answer- Like in World-WIde VW, the plaintiff sues where the injury is suffered. The court will dismiss for the lack of PJ. The court has not committed any act that affiliates it with OH. They have no reason to expect that they will be sued there. A rule of foreseeability would essentially make them have nationwide jurisdiction since the car could be foreseen in any state.
