Assignment 01 -2024
LLW2602
UNIQUE NUMBER: 773949
SECOND SEMESTER: ASSIGNMENT 01
1. A collective agreement acts as a formal contract between employers and trade
unions, outlining the terms and conditions of employment. In South Africa, the Labour
Relations Act (LRA) enables the establishment of bargaining councils, which play a
crucial role in facilitating negotiations between these groups. Once a collective
agreement is established through a bargaining council, it becomes obligatory for all
member employers and trade unions to adhere to its provisions.
Additionally, the binding nature of the collective agreement extends to non-member
employers within the bargaining council's scope, unless they have been specifically
exempted from its terms. This is because the agreement is considered a mandatory
regulation that applies to all employers in the relevant sector or industry.
