Op elk niveau zit het recht op wonen verankerd (Europees, na;onaal…)
Wonen als sociaal grondrecht zit juridische verankerd zowel na;onaal als interna;onaal

Wonen als sociaal grondrecht
Het recht op wonen is onaantastbaar en levensnoodzakelijk
Als je geen woning hebt is het moeilijk aan sociale ac;viteiten deel te nemen

Je mag uit je huis gezet worden maar het moet weFelijk verankerd zijn, het moet
noodzakelijk zijn en voor de rechtbank afgedwongen worden

De sociale grondrechten:
o Noodzakelijk voor fysiek en psychische ontwikkeling
o Opgenomen in interna;onale verdragen en grondweFen
o Staan “boven de wet”
o Willen een doel realiseren

Om je rechten te kunnen uitoefenen heb je nood om aan je grondrechten te voldoen

De overheid staat in voor het beschermen en verwerkelijken v/d voorwaarden opdat een
persoon vrij en in waardigheid kan leven
è Grondrechten moeten ins;tu;oneel verankerd worden
è Overheid mag deze grondrechten niet aantasten
è Rechten hebben = plichten hebben

2. 2de genera;e grondrechten: sociaaleconomische dimensie (20e eeuw)

Je hebt recht op:
o Arbeid
o Voeding
o Kleding
o Huisves;ng

è Je moet een bepaalde levensstandaard realiseren

Doel van deze rechten:
Het komen tot een volledig mens-zijn, er is solidariteit (er is geen wederkergiheidprincipe)
è Het moet geïns;tu;onaliseerd worden via de overheid MAAR ook toegepast &
gehandhaafd (niet enkel gecreëerd)
