Handicapping: curve/ boost scores of minorities on standardized tests (MCAT, SAT, LSAT, etc) 3. Preference: of 2 equally qualified candidates you pick the minority. Race= tiebreaker 2 Part Supreme Court Decisions - 1. Quotas are unconstitutional 2. Race maybe considered in fostering diversity 2 Types of Arguments IN FAVOR of Affirmative Action - 1. Backward looking: Justify affirmative action as compensation for past injustices 2. Forward looking: Notice that minorities have inferior education opportunities/ status/ income. So use affirmative action to bring up their level and make things better for future generations. 7 Arguments AGAINST Affirmative Action - 1. Affirmative Action is just reverse racism. ( Shoildnt race be irrelevant by now? 2. Why should young whites today have to suffer for what their ancestors did? 3. Some companies don't always like the minorities they hire. They are simply trying to reach a magic % in order to get government contracts and loans. 4. Sure a minority maybe qualified. But don't you want someone super qualified? It's doesn't matter what color the super qualified person is! 5. Large numbers of our population came to this country in early 1900's. They were discriminated against but never received affirmative action 6. Why base affirmative action on race? It should be base on income. 7. Affirmative action looks bad from a public image perspective. Gives the impression that minorities always need a boost
