• EU, Guidelines on implementation and evaluation of
restrictive measures (sanctions) in the framework of the EU
Common Foreign and Security Policy

51. EU restrictive measures should only apply in situations where
links exist with the EU …

52. The EU will refrain from adopting legislative instruments having
extra-territorial application in breach of international law. The EU
has condemned the extra-territorial application of third country’s
legislation imposing restrictive measures which purports to regulate
the activities of natural and legal persons under the jurisdiction of the
Member States of the European Union, as being in violation of (IL)”




De positie van de EU inzake sancties:

De Eu zegt: Sancties (= “restrictive measures” zoals bvb economische
dwangmaatregelen tegen Hamas) mogen alleen worden opgelegd als er een link
bestaat met de EU. Ze voegt er aan toe dat ze geen maatregelen zal opleggen met
extraterritoriale werking in strijd met het intl recht. Dit betekent niet dat ze elke
extraterritoriale toepassing verwerpen.

DUS:
- Territoriale werking is verworven
- Extraterritoriale werking is niet automatisch verworven, want het kan in strijd zijn
met het intl recht.
