Alien - person born in another country, but seen as un-assimilate-able "Yellow Peril" - Chinese Immigration Wave Stereotype; the idea that the Chinese will violently take over the US, take jobs, and take over WASP's (stereotype created by other immigrant groups) Naturalization Act of 1790 - "aliens" ineligible for citizenship; limited only to "free white 'persons' of good character"; extension of "perpetual foreigner" Aimed to Discriminate all Immigrants (keep them from becoming citizens)--> didn't necessarily affect the Chinese as much as WASPs thought it would because they weren't trying to become citizens- Chinese immigrants= sojourners (aka practiced return migration) => basically allowed WASP's to pick and choose who they wanted to become citizens WASP's assumed would effect Chinese Immigrants because they thought every Immigrant group was the same--> maybe created because stereotype of "yellow peril"= scare that caused this legislation to come into existence People v. Hall - *1854* -Chinese discrimination through legislation example Chinese cannot testify against whites => "A race that nature has marked as inferior" Page Act of 1875 - *1875* -Chinese Immigration Wave Discrimination through Legislation **California passes the 1st Immigration law in the United States--> did so without federal government consideration or permission**Legislation that was meant to keep out anymore Chinese immigrants that were trying to come to California Prohibited the entry of immigrants who were prostitutes and who were considered "undesirables" => 'Undesirable' meant/included/was considered whatever the WASP's at the time wanted it to mean (no clear definition so that they could group whoever they wanted into it) Chinese Exclusion Act of 1882 - *1882* -Chinese Immigration Wave Discrimination through Legislation Was in existence from 1st significant law restricting immigrants to the United States--> **Page Act= passed by California for only California **Exclusion Act= passed by Federal Government restricting entry into ALL of United States This is the Legislation that was a problem for Chinese because it kept them from their sojourner return migration; and since Naturalization Act kept from becoming citizens they could not leave California because they could no longer come back into the United States--> only citizens could travel in and out of US as they please. Chae Chan v. United States - *1889* -Chinese Immigration Wave Discrimination through Legislation Exclusion Act created by California government but then adopted and made constitutional by Federal Government because of this court case Its Federal Government that allowed to make things constitutional--> kept individual states from passing their own immigration laws; only Federal Government could pass immigration laws from now on
