Naleving en tegenmaatregelen
Tussen wie bestaat er geschillenbeslechting?
- Staten leven veelal internationaal recht na, omdat ze willen kunnen genieten van de
voordelen ervan International law of cooperation
- Vroeger: alleen geschillenbeslechting tussen staten
- Vandaag: geschillenbeslechting die betrekking heeft op conflicten waar internationale
organisaties???
Eenzijdige maatregelen
Door staat als reactie op schending rechtsplicht door de andere staat, om die staat ertoe aan te
zetten zijn verplichtingen na te leven.
1) Retorsie: (bijvoorbeeld verbreken van diplomatieke betrekkingen, opschorten van
ontwikkelingshulp) = niet verboden onder internationaal recht
2) Represailles: (tegenmaatregelen) = in beginsel verboden, maar niet onrechtmatig als ze
gericht zijn op het beëindigen van een onrechtmatige daad van een andere staat denk aan
sancties tegen Rusland en oligarchen.
Voorwaarden represailles (tegenmaatregelen):
1. Alleen voor gelaedeerde staten (injured states)
2. Aansprakelijke staat moet worden verzocht om schending te beëindigen en rechtsherstel te
bieden (art. 52 lid 2 sub a)
3. De staat die tegenmaatregelen wil nemen moet in onderhandelingen blijven met in gebreke
blijvende staat (art. 52 lid 2)
4. Geen tegenmaatregelen als geschil is voorgelegd aan internationaal tribunaal (art. 52 lid 3
sub b)
5. Tegenmaatregelen moeten evenredig zijn aan de geleden schade (art. 51)
Gebruik van geweld is niet toegestaan
Mag niet leiden tot schending van de mensenrechten (art. 50 lid 1 sub b ILC)
Niet in strijd met dwingend recht (jus cogens) (art. 50 lid 1 sub d ILC)
