Task 3

Employee Cooperation

You are required to produce a Factsheet explaining how organisations obtain the
cooperation of their employees aside from using motivational techniques.

Your Factsheet should include:
 Contracts of employment (contractual entitlements, employee and employer rights,
types of employment contract, disciplinary procedures, grievance procedures, union
membership, codes of behaviour)
 Employee involvement techniques (membership of work groups, suggestions
schemes, devolved authority and responsibility, open communications, types of
communication, organisational culture, national accreditation)
Please ensure that for each point explained that you include a relevant, real life example of
a business that does this and explain how this works.

This task provides evidence for P4
Introduction
Employee co-operation is an important part of human resource planning that tries to get
employees more involved in what is happening within the working environment. Tesco
achieve this by outlining the expectations of both the company and the employees and the
different groups that can help both parties to work together efficiently and effectively.
Contracts of employment

A contract of employment is the agreement made between the
employer and the employee. The employer will offer to give a salary
or wage in return for the employee to carry out duties which their
job description will explain. Tesco will have a contract of
employment for each employee they have and the contents of each
contract will change with each employee. For example, the amount
of hours they are due to work each week and their holiday pay.

Within the contract of employment, different types of entitlements are drawn up, as well as rights
and procedures which will be looked at below.

, Conor Cunningham P4

Contractual entitlements

The contract will outline the entitlements when employees are applying for a position in Tesco. This
is so that the employer and employee know what is expected of one another. These entitlements
may include;

 Disciplinary rules
 Hours of work
 Sick pay
 Amount of pay and the date of pay
 The type of employment. For example, seasonal, temporary or full time
 Notice period
 Pension benefits

Employee and employer rights
Within the employment contract, some of the entitlements contained within are statutory
entitlements (legal rights) and others are voluntary rights (which the employer sets). Express
terms are contained within the contract, for example, 28 days holiday per year. Note, in
Tesco this may vary for the different types of employment where some employees work
more hours than others.
There are also ‘implied terms’ within a contract which are not written down anywhere
because they are seen as too obvious. An example of an implied term is that the employer
will offer a safe place to work and that the employee will be honest and truthful. As the law
changes, so will employee and employer rights which exist in a contract of employment. In
Tesco’s contracts of employment, there will be many statutory employee rights such as;

 To not be the subject of discrimination
 To receive equal pay
 To not be unfairly dismissed
 To be treated fairly
 To receive a redundancy package
 To receive maternity or paternity pay
 To receive notice if there is a termination of employment
 To be paid at least minimum wage
 To receive annual leave
Employers also have rights which include that the employee works within health and
safety legislation, that they will give notice to the employer if they decide to leave their
job and they give Tesco notice if they are due to go on maternity or paternity leave.
