Joan’s departure
I am writing this letter of advice following our meeting earlier this afternoon to address your
concerns regarding Joan’s departure from Cakes, Bakes and Shakes.
Background
In December 2018, you and your brother, Ben, purchased a property intending to set up Cakes,
Bakes and Shakes. Together, you then took out a loan to cover the costs of refurbishments and
eventually agreed that Ben’s wife, Joan, could join the business. The business opened in
February 2019 and you each contributed to work and shared profits equally despite there being
no formal agreement.
On 19 March 2020, the three of you signed an agreement to alleviate uncertainty in the wake of
the pandemic. The business ended up growing, so you decided to expand by taking a leasehold
premise in Sherwood using Joan’s legacy to cover refurbishment costs. However, before this
could be finalised, Joan informed you and Ben that she wanted a divorce, to leave the business,
and to leave the country.
