COLLEGE 1.1 AARD, DOELEN EN BREONNEN VAN HET STRAFPROCESRECHT

Hoofddoel: toepassing strafwet op de werkelijke schuldige en voorkomen dat onschuldige worden
veroordeeld

Stille sms = moet kenbaar (vooraf weten) zijn voor de verdachte dat de politie bepaalde handelingen
verricht

Proportionaliteit (moet) en subsidiariteit (ander) komt nieuwe wet.

COLLEGE 1.2 EVRM EN EU

Art 6 EVRM eerlijk proces:

- Eerlijk en openbaar
- Ten overstaande van een onafhankelijke en onpartijdige rechter -> deel rechten in lid 2 en lid
3
- Binnen redelijk termijn

Ibrahim/Vs: procedure as whole -> dus vanaf wanneer sprake is van criminal charge. De hele
procedure wordt bekeken niet 1 deel/aspect. Deelrechten van lid 2 en lid 3 zijn verbijzondering van
lid 1. Gaat om min recht.

Saldus/Turkije -> recht rechtsbijstand rondom politieverhoor

Vidgen/NL en Keskin/NL -> ondervragingsrecht van (belastende getuigen).
