Summary Universal Jurisdiction, Connecting Links, and Civil Liability
Universal jurisdiction refers to the ability of national courts to try defendants for international crimes committed outside the state’s regular jurisdiction, to convict defendants who may have no connection with the prosecuting state prior to trial, and to bring accountability and justice to corners of the world where there are surely lacking. Although this seems like a legitimate idea to try to civilize the world and provide justice on international crime, universal jurisdiction is less potent and more problematic than expected in application.
