In terms of South African law. The right to privacy is under the terms of the common
law and section 14 of the Constitution of South Africa 1996. Social media plays a huge
role in our society and forms an easy way of communication and status within the
current world, but with social media being beneficial there are complications with the

In legal terms, privacy is described as an individual condition of life characterised by
exclusion from publicity. Even in the constitutional democracy this right can never be
absolute. One of the main problems confronting people in the information era is the
threat that social media poses to an individual’s right to privacy. privacy is also a core
of our democratic values and therefore an individual has an interest in the protection
of his or her right. Although privacy concerns are deeply rooted in the history, privacy
protection as a public policy question can be regarded as a comparatively notion.
