Your client wants a divorce. During the consultation, you establish that she is
currently in a customary marriage. According to the client, no ante-nuptial
contract was entered into. She wants to know whether she is entitled to any
property, movable or immovable, should she go through with the divorce.
You are required to research the historical development of customary law in as
far as it pertains to the rights of women to claim property from the joint estate
upon divorce. Your research should also touch upon the Constitutional rights
that played an important part in the development of customary law in this regard.
Law reform commission reports, case law and legislation as well as journal
articles should form the basis of your research.
You are now in the planning phase of the research. You decide to draft a research
plan in order to organise your thinking on the topic in question. This serves as
your draft research proposal. Your draft research proposal must be fully
referenced in accordance with the OSCOLA referencing style and must include
the following:
