The Importance of Roman Law​
Roman law is the foundation for many modern legal systems, including South
African private law. Its rules and principles shaped legal reasoning,
terminology, and the structure of law that is still used today. When Roman law
was later combined with Dutch legal traditions, it created Roman-Dutch law,
which became the core of South African common law. Understanding Roman
law helps explain why South African law is organised the way it is and why
certain legal concepts, such as property, contract, and delict, exist. Even
though modern legislation and court decisions now influence the law, the
historical and conceptual basis of many legal principles comes from Roman
law.

Development of Roman Law​
Roman law developed over many centuries and went through several phases.
In the early period of Roman history, law was heavily influenced by religion,
customs, and traditions. Rules were formal and rigid, and access to the legal
system was mainly limited to Roman citizens. One of the first written sources
was the Twelve Tables, which aimed to make the law public, although it
remained strict and technical. Later, during the classical period, jurists played
a key role in interpreting and developing the law. They analysed legal disputes
and wrote detailed explanations of legal principles, creating a more organised
and systematic legal system. Gaius was a prominent jurist who categorised
and explained legal concepts clearly. The methods and reasoning of these
jurists later influenced how law is studied and structured in modern systems,
including South Africa.

Justinian and the Digest​
Centuries later, Emperor Justinian compiled Roman law into the Corpus Juris
Civilis, which organised laws and juristic writings. The Digest, part of this
collection, preserved the opinions and analyses of earlier jurists, allowing
Roman law to influence medieval and modern European law. During the
Middle Ages, Glossators studied Justinian’s texts and added notes to clarify
difficult passages. Later, Humanist scholars examined Roman law in its
historical context to understand the original meaning of the rules. This
preservation allowed Roman law to influence European legal systems for
centuries, and eventually form the basis of Roman-Dutch law, which later
became part of South African common law.
