An antenuptial contract is a written agreement concluded by two parties before the marriage
is solemnised in order to regulate the matrimonial property system of their marriage. The
contract is executed before a notary public and must be registered in the deeds registry
within three months after its execution to be enforceable against third parties. The main
purpose of an antenuptial contract is to exclude the automatic system of community of
property and community of profit and loss that would otherwise apply to the marriage.
Through this contract, the parties determine how their assets and liabilities will be managed
during the marriage and how they will be divided if the marriage ends.1
