Heavy flooding in Giyani has created a severe humanitarian and governance crisis. Homes
have been destroyed, infrastructure has been damaged, children are unable to attend school
and communities cannot access water, roads and other basic services. In such
circumstances the Constitution places a strong responsibility on local government to act
quickly and responsibly. Local municipalities exist primarily to provide services and to
promote the well being of communities. When disasters occur these duties become even
more important because communities depend on the municipality for support, coordination
and recovery. South African local government legislation such as the Constitution of the
Republic of South Africa, the Local Government Municipal Systems Act and the Disaster
Management Act guide municipalities on how to respond to situations that disrupt service

removal and infrastructure even during times of crisis. When floods destroy infrastructure
and disrupt daily life the municipality must take immediate steps to restore these services
so that residents can continue their lives safely. 2 The destruction of homes and roads in
