1. Introduction

Freedom of association is a cornerstone of collective labour law in South Africa and
plays a vital role in regulating relationships between employers, employees, and trade

2. Constitutional Protection of Freedom of Association

2.1 Freedom of Association as a Fundamental Right

The right to freedom of association is entrenched in section 18 of the Constitution of
the Republic of South Africa, 1996, which provides that everyone has the right to
freedom of association. This right applies broadly to all individuals, including workers,
employers, and trade unions. In the labour context, freedom of association allows
employees to form and join trade unions of their choice and enables employers to form
employers’ organisations (Constitution of the Republic of South Africa, 1996).
