Constitutional Environmental Right in South Africa
Introduction
Environmental protection is not only a legal concern but also a moral and societal
imperative rooted in shared values about human dignity, sustainability, and
intergenerational justice. In South Africa, these values are formally entrenched in the
Constitution through the environmental right contained in section 24. While morals,
ethics, and cultural practices influence how society relates to the environment, they
differ fundamentally from environmental law in terms of enforceability, certainty, and
authority. This essay critically evaluates how the environmental legal framework relates
to morals and societal values, distinguishes environmental law from other social norms,
and explains how the environmental legal framework gives concrete effect to the
constitutional environmental right, unlike informal social norms.
Relationship Between Environmental Law, Morals and Societal Values
Environmental law is deeply influenced by societal values and moral beliefs regarding
the protection of nature, human health, and future generations. Morals reflect shared
beliefs about what is right or wrong, while societal values shape collective attitudes
toward issues such as conservation, pollution, and sustainable development (Kidd,
2011). In South Africa, values such as ubuntu, respect for life, and communal
responsibility resonate strongly with environmental protection principles.
However, while moral concern for the environment may inspire responsible behaviour, it
does not guarantee compliance. Environmental law transforms moral obligations into
legally binding duties. For example, the moral belief that pollution is harmful is
converted into enforceable legal standards through statutes such as the National
Environmental Management Act 107 of 1998 (NEMA), which imposes duties of care
on individuals and institutions to prevent environmental harm.
