teen die agtergrond van die actio iniuriarum gebruik.
Animus iniurandi ─ a synonym for the intention to harm, but used only in the context
of the actio iniuriarum.
Verdeling van skade – ʼn verdeling van skade tussen twee of meer persone wat teen

Defamation ─ the intentional infringement of a person’s right to his/her good name or
reputation.
Delik – ʼn daad wat op ʼn onregmatige (met ander woorde, regtens
afkeurenswaardige) en strafbare (met ander woorde, regtens laakbare) wyse vir ʼn
ander nadeel of verlies veroorsaak.
Delict ─ an act that causes harm or loss to another in a wrongful (that is, legally
reprehensible) and culpable (that is, legally blameworthy) way.
Feitlike kousaliteit – het betrekking op die feitlike oorsaaklike, oftewel kousale,
verband tussen die daad en die skadelike gevolge daarvan.
Factual causation ─ refers to the factual causal link between the conduct and the
harmful consequences that occurred.
Skuld – het gewoonlik betrekking op die laakbare houding of daad van ʼn dader. Die
twee hoofvorme van skuld is opset (dolus) en nalatigheid.
Fault ─ generally refers to the blameworthy attitude or conduct of a wrongdoer. The
two main forms of fault are intention (dolus) and negligence.
Regverdigingsgronde – verwere wat onregmatigheid uitsluit. Hulle omvat spesiale
gevalle waar oënskynlik onregmatige handelinge geag word wettig te wees omrede
die inbreuk op belange nie geag word onredelik te wees nie. Regverdigingsgronde
behels noodweer, noodsaak, uitlokking, instemming, statutêre gesag, openbare

Grounds of justification ─ defences that exclude wrongfulness. They comprise
special instances where apparent wrongful conduct is deemed lawful because the
violation of interests is not considered unreasonable. Grounds of justification include
private defence, necessity, provocation, consent, statutory authority, public authority
and official command.
