In this task I am going to be explain the impact of the legal and regulatory framework on recruitment
and selection activities in a business. In order to complete this task, I will be explaining what legal
and regulatory framework is and what is involved within the framework.
What is legal framework?
Legal framework is a set of rules that are created by the government in order to make new policies,
the legal framework is related to laws, acts, regulations and policies. 1

What is regularity framework?
Regularity framework is a method that is used to understand the significant cost and procedures that
are to be followed in a business, for example regulatory framework could be the outline the
conditions a new business has to follow in order to be properly registered and to operate legally. 2

Regulations that are put in place are used as a method to make businesses function better and
allowing them to meet their aims and keeping issues to a minimum. Improvements made are carried
out by taking action from the government, regulations are often developed as businesses are to have
issues related to discrimination, equality and more.

Sex discrimination act 1975/97
The sex discrimination act allows men and women to be treated equally, people are not to be
discriminated against their marital status, sex or gender reassignment. If in any case where someone
is to be discriminated would be counted as an act of discrimination from their sex, it is considered as
ignoring the laws put in place as unlawful. Discrimination very common in businesses however,
there are two different approaches of discrimination such as:

Direct discrimination, this discrimination is the opportunity given to a male or female who is less
qualified than their opponents but is hired due to their gender.
Indirect discrimination, is the discrimination where a set of requirements are followed to meet a
criterion for example only wanting men or women, someone tall or small or even specific features.

When a business is accused of discriminating someone on their gender there are issues that would
arise and cause issues for the day to day running of a business as there would be more awareness
towards the manor employees are treated reputation can also be ruined. 3


Equal pay act 1970
The equal pay act was made to make sure that men and women are to be paid equally, they are to
include childcare allowances, benefits, sick leave. Men and women are to be paid their wages
equally to someone who either does the same job, works of an equal value or does the same line of
work. The law of equal pay was not completely respected until 2009, before then women where
paid 37% less than men, the equal pay act was introduced to allow men and women to be equal.

Disability discrimination act 1995 and 2005
The act of disability discrimination is to ensure that anyone with disabilities is not to be disrespected
and is to be treated equally unless there are any respectable reasons for treating them less respect.
A person with disabilities would need to be considered for simple methods on how a business is to
access for example businesses would need to carry out acts to improve the accessibility for disabled
people, there would be a requirement of adding ramps for a wheelchair access or a hearing loop for
someone who is hard of hearing. The changes could be considered expensive for some businesses
and the welfare of the disabled person would cost the business money to be operating legally.
