Principles Governing the Choice of Municipal Service Delivery Mechanisms

Introduction

Municipalities play an important role in improving the quality of life of communities by
providing essential services such as water, sanitation, electricity, refuse removal, roads
and other municipal services. In South Africa, municipalities are required to provide
these services in a manner that is sustainable, affordable, equitable and responsive to
the needs of local communities. However, a municipality does not necessarily have to
provide every service directly through its own administration. The legal framework
allows municipalities to choose from different service delivery mechanisms, depending
on their circumstances, resources and capacity. The main framework governing this
choice is found in the Constitution of the Republic of South Africa, 1996 and the
Local Government: Municipal Systems Act 32 of 2000 (MSA).

The choice of a service delivery mechanism is therefore not simply a matter of political
preference. A municipality must consider a number of legal, financial, administrative,
social and developmental principles before deciding how a particular service should be
provided. Sections 76 to 78 of the Municipal Systems Act provide a structured
framework for making such decisions.

Principles that must be considered when choosing a service delivery mechanism

The first important principle is that municipal services must be provided in a manner that
promotes equitable and sustainable service delivery. Section 152 of the Constitution
establishes the developmental objectives of local government, including providing
democratic and accountable government, ensuring sustainable service delivery,
promoting social and economic development, promoting a safe and healthy
environment and encouraging community participation. Therefore, the municipality must
