Dear Penny
HR Concerns
Thank you for instructing LawRocks LLP to provide advice to ScienceTech Ltd (STL)
regarding their HR concerns.
1 Summary of Advice
Following our recent discussions, I have summarised below the relevant law applicable to
each issue you have raised and have included recommendations that STL should undertake
to minimise risks of liability.
Vallari Soneji and Kevin Taiwo – STL are advised to conduct informal meetings with both
employees, offering them incentives to stay. Where this fails, a formal resolution is the
advised next step.
Redundancies – STL must follow a fair and correct redundancy procedure to avoid risks
of unfair/wrongful dismissal and discrimination claims being brought against them.
Ranjit Kaur and Karen – Karen may have claims for unfair dismissal and indirect
discrimination if she is made redundant without STL taking reasonable steps to check if
she is pregnant or disabled. STL should implement reasonable adjustments if she is
disabled.
Managing working patterns – prioritising staff who do not work full-time hours for
redundancy would form the basis for automatically unfair dismissal and indirect
discrimination claims. STL is strongly advised against this.
Prestwick Plc – due to our firm’s representation of Prestwick Plc in the past, we are
unfortunately unable to provide advice in relation to this matter as it will constitute a
conflict of interest.
Whilst there are several potential claims and legal issues involving STL and its employees, I
have provided a preliminary assessment outlining the available options to each issue below.
