 Goal of labour law? why do we need it?
To protect the employees, why do they need protection?  the employee is thought of
being in the weaker position because he has to work for a boss, and this is what we called
subordination.

Labour law contract  you are entering a Subordination
Double dependencies between the employer and employee  financial dependency
That why you need some legal law
Your boss to some extent could tell you what to do  legal subordination

 Why are you entering a labour contract?
Employment security  Protection while you work, protection of lay over, social benefits
(employment benefits)

People are not working with a contract  self-employed  no subordination  labour law
is not applicable  no holidays
Why self-employed?  complete freedom, you are really enterprise
High skilled self-employed are doing quite okay but low skilled self-employed are vulnerable
to exploitation

 Which legal source is specific for labour law?
Collective agreements  agreements between different companies and trade unions
They are contracts working terms and conditions which are negotiated between
organizations, employers and trade unions that represents that employees on the other side
 important way to balance the power difference between employer and employee

 Is labor law private law or public law?  it is mixed
the basics of labour law is the freedom of contract, but it is limited by public laws 
minimum numbers of holidays, social security, laws discussed in this course is all formulated
by pubic organizations, also private organizations have an important role to apply in order
apply and implement these laws (CSR)

 Summary Why do we need labor law?
subordination  Power imbalance if you are on your own  compensating power
imbalance
Purpose  social justice  broad subject
It is also about economic goals  Compromise between social and economic
This has to do with collective bargaining is that employers and employees together find out
the working conditions of their relationships
