WEEK 1 – TECHNOLOGY AS A REGULATORY TARGET
The Law, Technology and Society (LTS) Model
• Core Idea
o A central framework for understanding the relationship between law and
technological development is the Law, Technology and Society (LTS) Model. The
model explains how technological innovation can create new challenges that may
require legal or regulatory responses.
o The basic structure is:
§ New Technology → Issue → Intervention
o This sequence does not imply that every new technology automatically requires
new laws. Rather, it provides a way of analysing when intervention may be
necessary and what form that intervention should take.
• Technology Does Not Develop in Isolation
o Technological development is influenced by a wide range of social, legal, economic,
and ethical factors.
o Developers do not create technologies in a vacuum. They often take into account:
§ Existing legal rules and regulations
§ Social expectations
§ Ethical values
§ Economic incentives
§ Public concerns
o For example, software developers creating a new online platform may already
incorporate privacy protections because privacy laws exist and because privacy is
regarded as an important social value.
o This means technology is not independent from society. Instead, technology, law,
and values continuously influence one another.
• Mutual Shaping
o The relationship between technology, regulation, and social values is often
described as mutual shaping.
o This means:
§ Technology influences society
• Technological innovations can change:
o Social behaviour
o Economic activity
o Communication patterns
o Expectations about privacy, safety, and convenience
• Examples include:
o Smartphones changing communication habits
o Social media transforming political discourse

o Artificial intelligence affecting employment and
decision-making
§ Society influences technology
• Social norms and public values influence what technologies are
developed and how they are designed.
• Examples include:
o Privacy concerns leading to encryption technologies
o Environmental concerns encouraging renewable energy

o Accessibility requirements influencing software design
§ Regulation influences technology
• Law can shape technology by:
o Restricting certain developments
o Encouraging innovation through incentives
o Establishing design requirements
o Creating standards for safety and accountability
• Regulation therefore acts both as:
o A constraint (limiting behaviour)
o A facilitator (enabling desirable innovation)
• The relationship is dynamic rather than one-directional.

o New technologies often introduce situations that existing legal frameworks did not
specifically anticipate.
o Examples include:

o These technologies may create:
§ Risks
• Potential future harms that have not yet occurred but could occur.
• Examples:

• Actual harms that are already occurring.
• Examples:
o Identity theft
o Privacy violations
o Online fraud
• Because these issues affect society, they create pressure for some
form of response.
• Issues as Calls for Action
o An issue becomes significant when it generates demands for action from:
§ Governments
§ Regulators
§ Courts
§ Businesses
§ Citizens
§ Civil society groups
o The emergence of an issue raises several questions:
§ Is there a real problem?
§ How serious is it?
§ Who is affected?
§ Does existing law already address it?
§ Is new regulation necessary?
o Not every issue requires a new legal rule. Determining the appropriate response
requires careful analysis.

• Existing Law Comes First
o Before creating new laws, it is important to examine whether existing legal
frameworks already address the problem.
o Many technological developments appear novel, but may actually fit within
established legal categories such as:
§ Contract law
§ Tort law
§ Criminal law
§ Consumer protection law
§ Human rights law
o Existing law frequently covers more situations than initially assumed.
• Regulatory Gap
o A regulatory gap exists when existing legal frameworks fail to adequately address a
new problem.
o This may happen because:
§ The technology creates genuinely new risks.
§ Existing legal concepts cannot be applied effectively.
§ Enforcement mechanisms are insufficient.
§ Responsibilities and liabilities are unclear.
o Examples:
§ Determining liability for fully autonomous vehicles.
§ Regulating AI-generated content that does not fit traditional legal categories.
§ When a genuine regulatory gap exists, intervention may be justified.
• Regulatory Responses
o Possible responses include:
§ Enforcement
• If rules already exist but are not being followed, the solution may
simply be stronger enforcement.
• Examples:
o Increased inspections
o Administrative penalties
o Regulatory investigations
§ Amendment
• Existing laws can be modified to better address new circumstances.
§ New Legislation
• New laws may be created when existing frameworks cannot
adequately address emerging issues.
