We zoomen in op twee speciale toezichtsprocedures van de mensenrechtenraad:
1, Speciale procedures
2, Universal periodic review
Hiermee sluiten we dan ook het charter-based toezicht af; Daarna b
ekijken we ook het treaty based toezicht.

De speciale procedures vallen onder de verantwoordelijkheid van de VN-MRR,
maar de mensen die erin zetelen zijn allemaal onafhankelijke experts.

, SPECIALE PROCEDURES
1. Onafhankelijke experten
❑ Onafhankelijke mensenrechtenexperten
– Special Rapporteurs, Independent Experts, Working Groups
– persoonlijke capaciteit - max. 6 jaar
– onbetaald – geen VN-staff
❑ Rapporteren over thematische issues of specifiek land
– thematische procedures (45)
– landenprocedures (12)
❑ Mandaat in oprichtingsresolutie Mensenrechtenraad
De mensen die zetelen in de speciale procedures zijn aangesteld door de VN-MRR,
maar ze zijn volledig anafhankelijk. Het zijn stuk voor stuk experten op hun vakgebied.
Om de onafhankelijkheid te garanderen, behoren ze niet tot het VN-
ambtenarencorps. Ze worden niet betaald door de VN. Enkel de reiskosten die ze
maken tijdens hun landenbezoeken worden terugbetaald.
Wat doen deze experten? Er zijn twee soorten:
- Experten die rond 1 specifiek thema werken = Thematische speciale procedures
- Experten die rond 1 specifiek land werken = Landenprocedures
Vandaag zijn er ongeveer 40 thematische experten, terwijl er slecht 13 landenexperts
zijn.

̶ Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment
̶ Special Rapporteur on extrajudicial, summary or arbitrary executions
̶ Special Rapporteur on the situation of human rights defenders
̶ Special Rapporteur on the human rights of internally displaced persons
̶ Special Rapporteur on the human rights of migrants
̶ Special Rapporteur on the issue of human rights obligations relating to the enjoyment of a safe, clean,
healthy and sustainable environment
̶ Special Rapporteur on trafficking in persons, especially women and children
̶ Special Rapporteur on contemporary forms of slavery, including its causes and its consequences
̶ Special Rapporteur on violence against women, its causes and consequences
̶ Independent Expert on the enjoyment of all human rights by older persons
̶ Independent Expert on protection against violence and discrimination based on sexual orientation and
gender identity
̶ Working Group on Enforced or Involuntary Disappearances
̶ Working Group on Arbitrary Detentions
̶ Working Group on the issue of human rights and transnational corporations and other business
enterprises 4
