International Human Rights Law and Its Relationship to Other
Branches of International Law
Introduction

International law encompasses a wide variety of legal regimes that address the
conduct of states, international organizations, and, increasingly, individuals.
Among its most influential branches is international human rights law (IHRL),
which aims to articulate, codify, and protect the inherent rights of all human beings.
Over the last century, IHRL has developed into a complex system of treaties,
customary norms, and institutional mechanisms. Yet it operates alongside other
specialized regimes that, while related, have distinct historical origins, conceptual
foundations, and legal mandates—namely, international humanitarian law
(IHL), international criminal law (ICL), and international refugee law (IRL).

This essay will first define IHRL, then systematically distinguish it from IHL, ICL,
and IRL, highlighting both overlaps and divergences. In doing so, it will also
critically reflect on the ways these regimes interact in practice, sometimes
harmoniously and sometimes in tension.



1. Defining International Human Rights Law

At its core, international human rights law is the body of international norms
designed to protect the fundamental rights and freedoms to which all individuals
are entitled by virtue of their humanity. These rights are not contingent on
nationality, legal status, or conduct; they are considered universal, inalienable,
and indivisible.

a moral and political consensus that state sovereignty could not be an absolute
