Scenario Recap:
300 people have illegally occupied a 15-storey, unsafe and dilapidated building in
Arcadia, next to the Deputy President’s residence. The owner, Mr. Imali Maningi, wants
them evicted immediately, and the City of Tshwane is concerned about their health and
safety.
(1) Which legislation is applicable to the eviction of people from buildings that are
unsafe or unhealthy?
Answer:
The applicable legislation is the National Building Regulations and Building Standards
Act 103 of 1977 (NBRA). Specifically, section 12(4)(b) of the Act allows a local authority
to evict people from buildings declared unsafe or unhealthy for occupation (UNISA,
2021:52).
(2) Under the legislation mentioned in question (1), who has the authority to
ensure that all buildings that are unsafe or unhealthy are altered or renovated to
render them safe or healthy for human habitation?
Answer:
According to section 12(4)(a) of the NBRA, the local authority, which in this case is the
City of Tshwane Metropolitan Municipality, has the responsibility and authority to ensure
that buildings are either altered, repaired or demolished to make them safe or healthy
(UNISA, 2021:52).
