QUESTION 1 PRINCIPLES OF ADVOCACY FOR DISABILITY 30 MARKS Jane has
an intellectual disability and a mental health diagnosis. She was living in
unsuitable accommodation and was worried she might become homeless.
One of her parents had died some time ago and there was a breakdown in
her relationship with her family. She was unaware of her welfare
entitlements and was not linked with any support services. Her parents’
outstanding bills had been transferred to Jane and left her in debt. Jane also
believed that her family violated her rights and entitlements regarding her
parent’s estate. Jane told her advocate that her family had attempted to
exclude her from her parent’s estate. She needed help to access not only
social welfare, but also housing, legal, disability, and social support. Although
Jane preferred to stay on in her parent’s house, it was unsuitable to her
needs and deemed unsafe. EDS4804 2025 ASSIGNMEN NO.2 7 Jane found
accommodation in another area but wanted to return to the area she had
known all her life. The advocate worked with Jane to agree on an advocacy
plan for her accommodation needs. Her advocate supported Jane with where
she wanted to live and offered her information about her financial and
inheritance rights, including clarification of who was responsible for paying
her parents’ debts. The advocate helped Jane to gather all the outstanding
accounts and communicate with service providers. Jane discovered that most
of the debts were outstanding before she had agreed to transfer the
accounts to her name. Her advocate helped her to obtain records that show
she had already moved out when some of the debt had accumulated. The
advocate applied on her behalf for a transfer to new accommodation and to
have the outstanding debts cancelled. Money she had paid to clear the debts
was refunded. Her advocate also helped Jane to get free legal aid and draft a
letter requesting information about her inheritance and address it to her
parent’s solicitor. Thanks to these actions, Jane’s rights to an equal share in
her parent’s estate were restored. Her advocate also helped Jane to get a
disability allowance, social welfare support, and a medical card. She also
linked Jane with a social worker and a day service. The social worker now
teaches her independent living skills. 1.1. Which form or forms of disabilities
does or do Jane have? (2)

Jane has an intellectual disability and a mental health diagnosis.

These two forms of disability are mentioned explicitly in the case, and they impact her ability to
manage various aspects of her life, such as understanding her entitlements, handling financial
matters, and engaging with social support services

, 1.2. In what form of accommodation did Jane live? (1)

Jane lived in unsuitable accommodation that was deemed unsafe for her needs. Although she
preferred to stay in her parent’s house, it was not a suitable living environment for her.

1.3. Why did Jane find herself in debt? (2)

Jane found herself in debt because her parents' outstanding bills were transferred to her name
after their passing. Additionally, she believed that her family had violated her rights regarding
her parent’s estate, which contributed to her financial burden. Jane also discovered that much of
the debt had accumulated before she had agreed to take responsibility for the accounts.

1.4. Mention several rights that Jane did not enjoy. (4)

Several rights that Jane did not enjoy include:

1. Right to adequate accommodation: Jane lived in unsuitable and unsafe housing, which
did not meet her needs.
2. Right to social welfare and support services: Jane was unaware of her entitlements and
was not linked with social welfare, housing, or disability support services.
3. Right to be included in her parent's estate: Jane believed her family violated her rights
by attempting to exclude her from her parent's estate.
4. Right to be informed about her inheritance: Jane was not given information about her
inheritance or the legal processes surrounding her parent's estate.
5. Right to financial justice: Jane was held accountable for debts that were not her
responsibility, including those incurred before she agreed to take on the accounts.
6. Right to independence and dignity: Jane was not receiving the support necessary to
develop independent living skills, which impacted her ability to live a fulfilling life.
