P2: Explain how legislation/ guidance applies to challenging behaviour.

LEGISLATION KEY FEATURES
The Human Rights Act 1998 The Human Rights Act 1998 is a proceed of
parliament which obtained royal assent in 1998.
This piece of legislation ensures individuals are
able to demonstrate their rights as a human
being within UK courts of law and that all public
corporations must be respectful, dignified and
fair towards all individuals.
The Convention on the Rights of a Child The Convention on the Rights of a Child is a
(UNCRC) legitimate transnational agreement which
outlines the cultural, political, social, civil and
economic rights of all children regardless of
their abilities, religion or race. It ensures that
children are treated as individuals with rights as
opposed to passive objects.
The Children Act 1989 The Children Act 1989 is a proceed of
parliament which obtained royal assent in 1989.
The act apportions duties to courts, local
authorities and parents in order to ensure that
children and young people are safeguarded and
promote their well-being. The Children Act
1989 focuses on the ideals that children and
young people are best supported and cared for
within their family environment.
The Care Standards Act 2000 The Care Standards Act 2000 is a proceed of
parliament which is responsible for a range of
care establishments such as; nursing homes,
children’s homes and independent hospitals.
The Care Standards Act 2000 was legislated in
2002 and superseded the Registered Homes Act
1984 and components of the Children Act 1989.
The Mental Health Act 2007 The Mental Health Act 2007 is a proceed of
parliament which obtained royal assent in 2007,
amending the Mental Health Act 1983, the
Mental Capacity Act 2005 and the Domestic
Violence, Crime and Victims Act 2004. The
Mental Health Act 2007 provides information
on when an individual can be treated, admitted
and detained within a hospital devoid of
consent. In order for this to be enforced certain
professionals must agree that the nature of the
mental disorder requires hospitalization.

government strategy aimed towards individuals
with learning difficulties. It was introduced in
