Wat is Chinees recht?
● Gemengde rechtspraak: Confucianistische traditie, elementen van burgerlijk recht en
socialistische erfenis
○ Binnen het confucianisme zijn diverse waarden van belang, waaronder oprechtheid,
medemenselijkheid, altruïsme, wellevendheid, onderscheidingsvermogen en trouw.
● Codificatie sinds Tang Dynastie (618-907)
● De "moderne" wetgeving begon aan het einde van de Qing-dynastie (1644-1911)
● Eerste codificatie van Chinees burgerlijk recht in de Republiek China (1912-)
● Socialistische invloed na de stichting van de Volksrepubliek China (1949)
● "Jigsaw puzzle"-wetgeving na de invoering van het "Hervormings- en Openstellings"-beleid
in 1978, in 1999 aan snelheid (en kwaliteit) won met de afkondiging van de Contract Law
(gevolgd door de Property Law in 2007, Tort Law 2009 ...)
● Nieuwe codificatie ronde sinds 2017
● 28 mei 2020: Afkondiging van een burgerlijk wetboek, met ingang van 1 januari 2021
● China heeft een jong rechtssysteem, maar het is tegelijkertijd ook vrij modern (vanwege het
vergelijkende werk van de wetgever)
