(a) Whether prosecutorial bail may be applied for the release of Allan Fuse

Bail is a procedure through which an accused person who has been arrested and
detained may secure temporary release from custody pending the finalisation of
criminal proceedings. The purpose of bail is to balance two competing interests:
the accused person’s constitutional right to freedom and the interests of justice,
including ensuring that the accused attends trial and does not interfere with the
administration of justice.

Section 12 of the Constitution of the Republic of South Africa, 1996 protects the
right to freedom and security of the person, while section 35(1)(f) specifically
provides that every arrested person has the right to be released from detention if
the interests of justice permit, subject to reasonable conditions.¹

In terms of the Criminal Procedure Act 51 of 1977 (CPA), bail may be granted by
the police, the prosecutor, or the court depending on the seriousness of the offence
and the circumstances of the case. Prosecutorial bail refers to the situation where a
prosecutor authorises the release of an accused person on bail before the accused
appears in court. This form of bail is regulated by section 59 of the CPA.²

However, prosecutorial bail is only available for certain less serious offences.
Section 59 provides that a prosecutor may grant bail where a person has been
arrested for an offence listed in Schedule 1 of the CPA, excluding serious offences
that fall outside the prosecutor’s authority. The prosecutor must also be satisfied
that the interests of justice permit the accused’s release.³

In Allan Fuse’s case, he has been arrested for arson. Arson involves the intentional
and unlawful setting alight of property belonging to another person. Although no
person was injured, the offence resulted in extensive property damage because an
office building in the Durban CBD was destroyed. The seriousness of the offence
means that it is unlikely that prosecutorial bail would be appropriate.

Arson is classified as a serious offence, particularly where substantial damage has
